打工時請老闆依規定加保勞工保險之重要性 (The importance of asking your boss to insure labor insurance in accordance with regulations)

許多學生都有打工的經驗,但不是每個人都會注意到勞工保險的重要性。

以我為例,從高中在補習班擔任工讀生開始,到研究所畢業後的第三年為止,

換句話說,無論是到處兼差打工十年,跟在同家公司全職工作十年,累積的保險年資同樣都是十年。

不過,由於大學期間的打工,大部分是零散、短期的,當時,我尚未認識到「準時加入勞工保險」的重要性,也不懂應該請雇主依規定辦理,

實際上,有很多老闆的確對工讀生還蠻不錯的,但就是為了節省成本,勞保的部分沒有確實執行。

目前我已非勞工保險被保險人,而是改投其他種類的保險;並且,由於我距離能退休的年齡還很久,保險年資對我的影響有限。

不過,依照勞工保險條例的規定,雇主是應該在員工到職日當天辦理加保勞工保險(或就業保險),並且按照實際薪資所符合的投保薪資級距,去幫員工加保勞工保險。

但更要緊的是,如果員工到職後發生可請領給付的相關情事,卻因為老闆沒有在到職日辦理加保(包括根本不加保或延遲加保),因為不是被保險人,就無從請領相關給付。

雖然有這些罰則,終究不如一開始就請雇主按規定加保,來得有保障,也比較省時省力。要用到法律,通常都是比較耗神的。
