虐傭案發生後'我就靜觀後續發展、結果不出預測、內中另有內情。

。這件事很可能是菲傭烏龍事件、廾年前加洲有EDD罰旅館業主
4萬3千美金
後遭法官判EDD於法無據、工時以實際工作時間計算、
罰款4萬3千美金歸還業主。

MEMO                        Dated :Saturday, November 12, 2011

This MEMO stands for the working agreement between Ms. Caissa Bonds and
Mr. Michael Han under the terms and conditions setforth below:
1.Duration: This agreement is renewed from June 21, 2011 to June 20, 2012 for
   a year effective from the date of signing.  Both parties are bond to this
   agreement unless either parties desires to terminate this agreement
 by written notice 30 days in advance. This MEMO is renewable
 automatically at the end of the year unless otherwise notice is served.
2.Job contents: Ms. Carissa Bonds will  work as manager of the motel
  on full time basis. She will work less than actual hours a day 6 days
 a week except Monday. In accordance with California Law of wages
  and works less than 39 hours a week.   Since this motel is seasonal
  Resort motel she is required on the job and paid from June21 through
  June 20 2012 with the one year wage about  $1,600.00 a month. 
  That includes US$4.75/room maximum 6 rooms a day for housekeeper’s
 job.  She is staying   room #6 and utilities free of charges plus US$500
 in exchange for her to care taking of the motel during the off-season
 period.  Other details includes:
   A. She understands that her job is based on actual working hours
 (watching tv sleeping etc is not 
working & signed with comprehension
  of California Court Case.)  As receptionist take the reservation and
 daily routing of the office work.
   B. She will control the supplies. She will do minor maintenance
 work within her capacities such as change the light bolb Turn on
 the gas-heater checking the water safety level, ETC one-hour a day.
 She is to check maid job
in addition to her minimum 5 rooms from
 time to time to make sure its up to motel clean standard.
 In the meantime to ensure that light gas and water are turned
 off after guest checkout. Supervising the person working in this
 motel to ensure that no drug and alcohol in the work Plac
e
   C. Screen the new-hiring maid and handy man with criteria
 of law abiding legal residences.
   D. Keep the sales activities in hand written form and file monthly
  income and expenses reports.
   E. Carissa bonds will do her own tax return.
   F. Other small job may be added to her job content.
3. From Apr 1, 2011. To Oct 30, 2012, the 7 months earning is about
     US$
11,200.00. With an offer of $500 a month for caretaking the
     winter season if needed.
 Maintenance job is paid from Tilt when
    David deem it necessary
works to the motel with a budget $200
    to be paid to him monthly. It is understood that he   
does not have
    income not even food stamp from US government. As a favor
 
   Michael Han pays to him from his own pocket in a good will gesture.  
4. Security: This motel can not be left unattended therefore, in case
 Ms. Bonds  take vacation,
She may ask her friend to take care of
 this motel temporarily.
 However, she is responsible for their 
 Integrity to avoid any illegality on the premise. Should she find
 anything wrong she must contact police 
Immediately to avoid
 confronting intruder 
directly.
5. This MEMO is based on mutual trust at good will and her year income
    is about $18,000 ~$20,000 based on 12 month a year calculation.
 If room 
#6 is included  it would mean $850/months amont to
 $10,200 
annual extra=$28,000 income let along other expenses.
   At end of year if after tax there is sufficient profit Ms.
Bonds will
   be paid one month bonnets.
6. Ms. Bonds, under awkward situation with her family, was given room
   #21 & #22 as temporary shelter with her roommate Mr.Bradley Schatt
   & 3 kids, and now room #7 until the 4 have a place to live. 
However, 
   the shelter serves as good will but they have to vacant the room #7 
   by end of 2011.
7. Mr. Bradley Schatt is not an employee of Muir Lodge & the check 
   #580 paid to him$1,103 was Ms. Bonds ½ month salary (7/16~7/31) 
   under her request.
8. This MEMO signed by both parties is a part of the agreement with
    legal 
binding effects.

虐傭案 外交部:帳務清白 工時合法

    我國駐堪薩斯辦事處處長劉姍姍虐待菲傭遭美國逮捕一案,外交部今天發佈新聞稿指出,初步調查劉姍姍與所聘僱的菲傭聘僕之間的帳務屬清白,工時屬彈性。此外,外交部也重申台美關係發展良好,我國維護程序正義,絕非護短。

    針對劉姍姍本月10日遭美聯邦調查局逮捕並被拘留一案,外交部原以美方程序處理不當,有違反特權豁免協定之嫌,為保障我國其他駐美人員權益,外交部隨即向美方提出強烈抗議,同時啟動內部調查。

    外交部說,根據初步調查結果,劉姍姍與該名菲傭之間的聘僱契約帳務是清白,該菲傭契約正本載明月薪原為1240美元,然菲傭主動向劉姍姍表示,有關其住宿、伙食、醫療及保險等費用,自願從其薪資中每月扣除790美元支付。

    因此,該菲傭薪資與其他費用扣除後,每月仍可實領450美元。此外,菲傭住在官舍中,由我方外交部提供醫療等保險外,劉姍姍仍每月給菲傭140美元的食品雜貨費,總計實領590美元,此數字與駐堪薩斯辦事處每月核銷之金額一致。

    外交部指出,劉姍姍單身無眷屬,平日都在處理公務,不在家時間甚長,大部分時間官舍僅有菲傭一人在,除不能擅離外,菲傭行事自由,其工時雖非為「朝九晚五」的固定時段,但也並非所平均一天工作長達15至18小時的高工時。

    至錄影監視器則是辦事處官舍舍的必要設施,原即為官舍安全而安裝,絕非對僕役全時監視所用。

    目前外交部仍透過所有管道與美方接觸,並聘僱當地律師並派員前往堪市協助案件處理,盼助劉姍姍儘早獲釋。至於全案實質內容部分,外交部表示,目前仍在調查之中,但絕無護短之事;外交部也強調,台美關係近年發展良好,絕不受此案影響雙方密切友好關係
