我不同意朱敬一院士講授對台灣現有司法問題看法. 他認為司法法律的制定與審判, 須符合社會情感. 無法獨立於社會外，否則難被人民接受。朱敬一院士對法律及社會情感翻譯非全正確. 我對台灣司法不熟, 但我本人對美國司法法律相當熟. 是的七名成年男子性侵一名智障女，竟全判無罪, 台灣法官對法律分析是有離譜. 朱敬一還 說. 心智未成熟的六歲 兒童遭性侵, 得視其是否被暴力脅迫或違反意願來 判刑, 台灣法官審判 對法律解釋是有相當問題. 但無論如何, 司法法律的制定與審 判是依法律架構下來決定罪刑, 應不須符合社會情感. 是的美國必須要有四年大學畢業才能上法律系, 而必須先經律師考試, 及先經過執業 律師多年歷才有資格遴選當法官. 我認為台灣現有問題是法官製造司法法律, 美國法官是翻譯及分析法律 US constitutional law. 而美國議員是製造司法法律. 侵若有暴力脅迫或違反意願來判刑 usually 重刑, 以下我依英文解釋美國司法法律對 性侵罪的判刑: Sex crimes are a general category of offenses that have important common elements.
