| 關於維根斯坦(Ludwig. Wittgenstein, 1889-1951)的理論之評論 The approach fits well with the position of many legal indeterminacy theorists. They need not, and do not . deny that there are “easy cases” in the law. However, they attribute the easiness of these cases not to language but to a ( temporary) consensus of the society ( or the relevant legal subset of society). 此作法非常符合許多非決定性法律理論學家 [(indeterminacy/非決定性)亦即法律判決絕不能單從法律原則中得到，而要同時考量外部的政治與社會] 的立場。而他們無需也不會否認，在法律中會有所謂的「單純案情」。但認為對這些案情的單純判定特性，不是歸因於外在的語言表達(該是案情審理的語言表達)，而是歸因於社會(或是類似相關社會法律專業人士次族群-所謂的法界專業人士圈子)的共識(暫時性的共識)。 謹此提供參考！！ |
