第三條 契約價金之給付 契約價金之給付，應為下列方式（由招標機關於招標文件中載明）： ¨依契約價金總額結算。契約價金總額，除另有規定外，為完成契約所需全部材料、人工、設備及施工所必須之費用。如契約內另訂有部分項目為實做實算者，該部分依實際施作驗收數量核實計給之。因契約變更致履約標的項目或數量有增減時，就變更部分予以加減價結算。若有相關項目如稅捐、利潤或管理費另以一式列計者，應依結算總價與契約價金總額比例增減之。但契約已訂明不適用比例增減條件者，不在此限。

Article 3 The payment of Contract Price The payment of contract prices shall be performed as follows (The requirements shall be detailed in the bid invitation documents by the bid publicizing agency.) According to the total amount of contract prices, unless there are other requirements regulated, the said total amounts are composed of all the amounts required by materials, labors, equipments and construction engineers for this contract. If within the contract, it is listed with alternative items available for actually operational expenditure settlement, the said amounts are thus available for settlement according to the actual expenditures. If there is any increase or decrease happening to the items or quantity of contractual performance goals after contract amendment, the payment shall be settled according to actually increasing or decreasing amounts. If there is any relevant item which shall be separately settled such as tax, profit or management fees, it shall be increased or decrease based the ratio against the total settled amounts to the total contract prices, except the conditions to exclude the available settlement under the said situation within the contracts.
