商品網址: Open Mind 2-e (2) TB Premium Pack with DVD-1片 & Class Audio CD-1片 & Webcode (Asian Edition)商品網址: Open Mind 2-e (2) TB Premium Pack with DVD-1片 & Class Audio CD-1片 & Webcode (Asian Edition)2018-05-19 19:37 〔記者鄭鴻達／台北報導〕對於威權時期的司法人員「除垢」議題，候任促進轉型正義委員會兼任委員尤伯祥說，目前無法律依據可進行「除垢（lustration）」，促轉會能做什麼，應回歸「促進轉型正義條例」的授權，但對於追究加害者責任，立法者的授權是不清楚的。 尤伯祥今（19日）出席紀念殷海光先生學術基金會舉辦的「何謂加害者？談轉型正義與促轉條例的加害責任問題」研討會，在學者們發表演說後，有聽眾提問，是否能仿效德國的轉型正義，針對威權時期的司法人員進行「除垢」？ 尤伯祥回應，目前無法律依據可讓促轉會進行除垢，即使要進行轉型正義，都要有法治基礎。他強調，促轉會能做什麼，都應回歸「促轉條例」的授權，其授權都很清楚，就是包含開放政治檔案、平復司法不法等五大任務。 尤伯祥說，追究加害者責任部分，立法者給的授權是不清楚的，他對於解職軍事檢察官、追究告密者的責任的態度是比較保守的，這部分，還需透過社會共識、透過更進一步細緻的法律及很多的配套立法。 尤伯祥也說，雖然追究責任在法律技術上是困難的，但仍要做到追究加害者責任的工作，「促轉條例」的法律用語非常有技巧，只有講「追究」、「釐清」加害者責任，但沒說要用哪種手段，「追訴」只是其中一種選項。 尤伯祥強調，「促轉條例」立法者給予促轉會很多空間，上述作法需凝聚社會共識後去選擇。他直言，「平庸的惡（banality of evil）」存在於整個公務體系中，人很容易屈服於體制、科層中的責任分擔，若不進行轉型正義，公部門中的是非對錯很難建立起來。 「除垢法（Lustration Law）」為許多東歐前共產國家如捷克、匈牙利與波蘭，在民主化後進行轉型正義時所採取的一種方式，也是一種「去共產化」的形式；德國在兩德統一後進行司法除垢，將在東德政權下任職的司法人員全數解職，經「除垢檢查」後方得任職。 博客來 博客來網路書店 9D25028CFA339A30 |
