a car hit our backyard tree the driver ran away police with dog cant find the black so far

today the whole day some maniac driver made lots noice (driving back and forth very weird, it sounds like the same driver). when we moved here it frequently happened then stopped then sometimes happened again. 

until 11:20? pm i heard huge bump noice and came out, found a car hit our back yard tree with hat on the grass and poilce already arrived (seemed chased the car) and told me it was accident, i asked any wounded and answeared a blackman ran away, also ordered me stay home.

i was nervous wonder the runner would hide and sneak around our house so immediately checked our parking place and turned on all indoors/outdoors lights and verified every room, basement, front porch. and made 2 photos on the car with police thru our kitchen and sunroom windows.

then worried any damage in our backyard especially the tree(in case fall down in the future and have to pay $1000+ to remove,not mention any one illegally passing our yard gets hurt) so came out to confirm with the police how they protect us from any damage but the police already got upsset forced me stay in house before i went to the site. 

So i called 911 to report it in case, then was told they would request a police talk to me later.

Later a police came by but only asked whether i went outside, i told him only our parking place and went down the damaged car and back to house. he said they saw me, because the dog is searching the runner, i should stay in home. 

12:20?Am the damaged car was towed away the police still parking on the side road.

if the driver is the same guy made huge noice today and before, i do hope the police send him to jail. when we moved here i wonder why no one report the police, many times i wanted to call but stop by my spouse, he is afraid the nut would do bad things to us if I call 911.

i hope the damaged car and the hat .. left on the site, the police should catch him soon. and i would pay attention to the case.

ps 12:42Am all police car left. very weird our neighbourhood dog scream after police left. tonight is a long night with scare....

the crashed happened is very likely the police chased the driver. it is T roads and when i went toward to side, i can see T road was blockaded by 3 police cars. the hitter can't turn any direction or go straight. the hitter car was on our yard, it supposed no need to blocakde the T roads if not by chasing.

Ecorse police chase a suspect who ends up crashing into someone's porch 10 months ago.

Now the homeowner says police are sticking her with the bill. So the question is who pays for the damage?

The chase happened back in October of 2016; it ended with a crash on Knox Street in Ecorse. Renee Qualls, who lives here, says her porch is still crumbling and her house has a huge hole in it.

"This porch is unstable," said Lonnie Pettway, Qualls' boyfriend. "It is starting to crack on the inside and on some of the walls."
Pettway says he was there when it all went down.
"We were actually parked right in front of the driveway that the truck came through," he said. "It definitely would have hit us if we would've waited probably another minute."
Ecorse police say a 16-year-old was driving recklessly and was evading officers giving chase, even ramming a police car.

Police say the driver cut through the backyard, hitting a trailer and knocking it into two parked cars before crashing into the home.
Now a year later, Qualls has assessed the damage and said they are looking at a bill of nearly $8,000.
"We need it fixed," he said.

Qualls said she doesn't have insurance and cannot get any until repairs are made. They are wondering what they are supposed to do and thought police would have followed up.
"We never heard anything," Pettway said. "She's been up there a couple times to figure out what's going on."

But this mess according to police isn't their responsibility. Officers said Qualls can either sue the driver or his insurance for the damages or bring in the appropriate paperwork along with the damage assessment, to police. Then she would receive a victim compensation form from Wayne County.
"We need all of that information so we can add it to the report," said Det. Sgt. William McCaig. "(Then) she should (get a letter from Wayne County)."
Although it's been almost a year and a bit confusing, Qualls is glad this is all being straightened out. By the way... that driver has been arrested and charged.
--the family were lucky got reporter reporting their case so the problem solved.

here is other people discussion and their believe as:

if a police cruiser is chasing a car and that car hits yours, who will pay for damage on your car?
A. Well, if you weren't driving on the wrong side of the road, had your license up-to-date and all your paperwork with your car correct, then the person the police were chasing would have to pay for your repairs. Unfortunately, if you driver's license had expired the day before and you were driving to the DMV to get them updated, then, you would be at fault b/c you shouldn't be driving on the road...

B. I think your insurance has to pay. Police, Fire, and ambulance corps are exempt from this. My wife's car was parked and hit by an ambulance. We had to cover the whole thing through our insurance even though the ambulance wasn't even on a call and simply made a mistake when they hit her car.

C. You're pretty much on your own. It's likely that the person the police were chasing is either driving a stolen car, or there's some other reason for insurance not covering him, so if you don't have your own insurance,. you're out of luck.
You could try to sue the police department for allowing the pursuit to get out of hand, but you probably won't win.

I believe most of us would prefer the hit-and-run pays for the innocent damages, but unfortunately many runners have no auto insurance or under, most of them no decent income or even a criminal type can't pay even afraid be punished if sue the hitter in the small claim court then the only can pay are the police dept who chased the hitter.

certainly police dept. knew very well what would happen to their dept. so the less people know the best for them.

the hitter's car inside and outside, our yard land i didn't see any blood, the front of car was damaged, glasses broken but not serious(the car's lights still on), to me the hitter is very likely a criminal. i'm more care about when driver be arrested and charged. can we be informed by police dept.? how to trace the case status?
ps i ddin't hear the police chasing siren so not sure why the police so quickly showing in our yard site. and the police knew the driver is black who ran away.

with my spouse we verified the accident site again and found the hitter ripped off the fiber pole cover cap that 3 wires naked and exposed. i immediately called the city left voice message that they should send worker to make sure it is safe.

my spouse would rather leave it behinds and told me it is city problem. but i am carefully type person, don't want any bad thing happens. i have no confidence that last night the policemen would report to fiber-related dept.(or private fiber company) to take care of it.

it is dark and very easy missing the damages.

civil plaintiff's attorney

--it is hardly can get free consultation. when we suffered the bloody dentist family from taiwan(the grandfather was taiwan officer in chicago as 武官) frauds, we had to pay consultaion fee $50? for an hour, after talked the attorney told us he won't take the case because amount too little. we did call the county and he was on the recommand listing. 

Later we called county for help but nothing they can do about it. when the case is not big enough unless you have lawyer relationship to help you or your company provides, you can do nothing about it.

Crtainly if you are the poor class you might qualigy for free lawyer povides by county.

but i suspect it still existing since many states/cities seriously broken.

Dupage county--Small claims courts are courts of limited jurisdiction that are designed to hear civil cases between private litigants. Their purpose is to prevent clogging up the formal court system with relatively petty matters through a less formal forum.  Small claims courts also limit the judgments awarded.  This limit is generally set at $5,000 – though it may vary from jurisdiction to jurisdiction.
There is a court fee to file a small claim in DuPage County that varies based on the amount of your claim. For suit amounts that are less than $250, the fee is $116; for any amount greater than $250 up to $1,000, the fee is $169; and for any amount greater than $1,000 up to $1,500, the fee is $174.
--in the beginning we had very tough time to find attorney because under $10,000 belongs to small claim court. we visited county for help the clerk gave us phone number to find out lawyers take small claims. but we paied got turned down, all we got advic is NOT WORTH to file the claim because the lawyer fee plus other fee and such professional(dentists) related hardly can win because he didn't have that experiences. 

I did call those managed medical related lawyer office thy told us only accepted car or job-related accidents.

--after the bloody dentists case we did try to join my spouse company's program that paied monthly to get sttorney. but it is useless because can't get local attorney represent you but on-line chat only.

the police dept called me back and provides reporting number, $5 to get a copy.

i called our auto insurance company and found out: 

1. our auto isurance company won't take the claim unless we have home insurance or our car is damaged by the hitter.

we have to get police reporting see whether the ran away driver has auto insurance with property coverage so file the claim to the hitter's insurance company by ourself. if not then we have to thru small claim court.

2. if we have home insurance then they will take care with or without the hitter insurance.(however i'm not so confidence in it).

--according to my spouse opinion the ran away hitter is very likely no auto insurance at all. it just like before waste time and money.

i searched the similar case happened to other people as below:

A car hit the tree in my front yard and severely damaged it. Driver was cited. What should I ask for in settlement?
The tree was a mature magnolia. An arborist advises it needs to be removed for safety reasons. Insurance company asked me to send estimates but didn't say for what - for removal, replacement of a like kind tree, value of the tree or something else? Thanks.
--Evaluating damages in a civil case take years of practice and experience. I would suggest you meet with a civil plaintiff's attorney about your situation. Most of them offer free consultations, and afterwards you will have a better understanding of the law, and to what you are entitled.

--when i called(11:00Am) to follow up our case, the police station told me didn't find record and it is a shift night, suggested me call again after 11Pm. i knew this is why whenever bad things happen americans are disallowed but stay home...no one knew what happened, how to get damages recovery/make-up.... the police tell as nothing as they knew to keep away "trouble".

Fortunately i called 911 last night with my address and phone number. according to police station website if i need police reporting the crash incident i have to pay $5 or $11, i also need police issues ticket number. which i have none. not can file claim to our insurance company as no hiter car's licence plate(the police forbid me nearby the site).

After i called the lady told me she would email to the department to find out who managed the case and the police on the site should call me back.
